The court declared illegal the tightening of the conditions of detention of Viktor Filinkov, as well as recognizing him as a “malicious violator”

On August 16, the Sixth Court of Cassation in Samara declared the transfer of Viktor Filinkov, convicted in the Network case, to a cell-type premise (PKT) and a punishment cell (SHIZO) as illegal, as well as recognizing him as a “malicious violator”. This is reported by the RUPRESSION Telegram channel.

Earlier, the Orenburg Regional Court also ruled in favor of Filinkov, but the administration of IK-1 Orenburg filed a complaint against this court ruling. Thus, the court of cassation dismissed the complaint of the EC and upheld the decision of the regional court.

“Thanks to this victory, the colony already withdrew its idea of ​​transferring Viktor to a prison regime in July. In addition, the illegal assignment of the “malicious” status to Viktor in October 2021 entailed violations of his rights during subsequent disciplinary sanctions, which are now also being appealed in court, and some have already been canceled by the court,” writes RUPRESSION.

The status of a “malicious violator” was assigned to Filinkov in October last year for refusing to clean the exercise yard. He and his defender Vitaly Cherkasov disputed this confession, as the administration of the colony demanded that the courtyard be removed during the walk, that is, outside the schedule. The decision came into force on June 9, but on June 29 the status was returned.

The criminal case on the so-called terrorist community "Network" was initiated by the FSB in October 2017. According to investigators, a group of anarchists and anti-fascists from several cities in Russia allegedly created an online community that was engaged in planning the revolution and terrorist attacks. In February 2020, seven defendants in the case were sentenced to imprisonment for a term of 6 to 18 years. In the summer of that year, Filinkov received 7 years in prison.
